Privacy Policy

A. Information You Provide

When you create an account or use the Platform, we may collect information including: name, email address, password (stored in encrypted form), profile photo, biography, company name (Brands), social media usernames and links, creator categories, self-reported follower counts, average views, pricing information, portfolio links, campaign preferences, messages sent through the Platform, reviews and ratings, support requests, and other information you voluntarily submit.

B. Payment Information

Payments are processed by Stripe, Inc. through Stripe Connect. Klayta does not collect or store your bank account information, full payment card information, tax identification numbers, or government-issued identification submitted during Stripe onboarding. That information is collected and maintained by Stripe in accordance with Stripe's own Privacy Policy. Klayta stores only information necessary to administer your account, including Stripe account identifiers and onboarding or payout status.

C. Automatically Collected Information

When you use the Platform we may automatically collect: IP address, browser type, device information, operating system, log files, session information, pages visited, time spent on pages, referral URLs, error reports, and cookies and similar technologies.

We use your information to: create and maintain user accounts; operate the Platform; facilitate Deals between Brands and Creators; process escrow payments; communicate with users; administer disputes; verify Platform activity; prevent fraud; detect abuse; enforce our Terms of Service; improve Platform functionality; respond to support requests; comply with legal obligations; and protect the rights, safety, and property of Klayta and its users.

Messages exchanged through the Platform may be monitored, reviewed, retained, and used for purposes including: investigating Terms violations; detecting fraud; preventing abuse; administering disputes; protecting users; complying with legal obligations; and improving Platform safety. Users should not expect Platform messaging to be private as between themselves and Klayta.

Creator profiles may contain information made publicly available by the Creator, including: display name, profile photo, biography, social media links, creator categories, self-reported follower counts, average views, reviews, ratings, and portfolio links. Users are responsible for information they choose to make publicly available.

Leaderboard Display

By creating a Creator account on Klayta, you acknowledge and consent that if your account reaches the top 10 ranking on the Klayta Leaderboard (overall or by niche), your public profile information - including your display name, avatar, niche, verified badge, tier badge, average rating, and completed deal count - may be displayed publicly on the /leaderboard page. This display is based on your verified deal activity on the platform. You may opt out of leaderboard display at any time by contacting us at legal@klayta.com or by adjusting your privacy settings when that feature becomes available.

Reviews submitted following completed Deals are publicly displayed on user profiles. If an account is deleted, reviews may remain associated with a "Deleted User" profile to preserve transaction history.

We use cookies and similar technologies to: maintain login sessions; remember user preferences; improve Platform performance; understand Platform usage; and maintain security. Most browsers allow users to disable cookies, although doing so may limit Platform functionality.

We do not sell your personal information.

We may disclose information to:

• Service Providers - including providers of payment processing, cloud hosting, analytics, customer support, email delivery, and fraud detection.
• Other Users - certain profile information, reviews, and Deal-related information is shared with other Platform users as part of normal Platform functionality.
• Legal Requirements - we may disclose information when reasonably necessary to comply with law, respond to legal process, enforce our Terms, investigate fraud, protect users, or protect Klayta.
• Business Transfers - if Klayta undergoes a merger, acquisition, financing, or sale of assets, user information may be transferred as part of that transaction.

We retain information only as long as reasonably necessary for: operating the Platform; maintaining transaction history; resolving disputes; complying with legal obligations; and enforcing agreements. Certain records relating to completed Deals may be retained after account deletion.

We implement reasonable administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.

You may: update profile information; change account settings; delete your account; and unsubscribe from marketing emails. Administrative emails relating to Deals, payments, disputes, and account security may still be sent as necessary.

The Platform is intended only for individuals at least eighteen (18) years old or the age of majority in their jurisdiction. We do not knowingly collect personal information from children.

The Platform is operated from the United States. If you access the Platform from another country, you understand your information may be transferred to and processed in the United States.

If applicable law provides additional privacy rights, including rights to access, correct, delete, or obtain information regarding personal information collected, users may contact us using the information below. Klayta does not sell personal information.

We may modify this Privacy Policy from time to time. Material changes will be communicated through the Platform or by email before becoming effective where required by law. Continued use of the Platform after changes become effective constitutes acceptance of the updated Privacy Policy.
